Los Angeles, CA — On July 13, 2018 at 9:00 a.m. in Department 28 of the Sacramento Superior Court, Judge Richard K. Sueyoshi will rule on former Attorney General candidate Eric Early’s Petition for Writ of Mandate seeking to remove Xavier Becerra’s name from the ballot in California’s upcoming General Election.

California law requires that to be elected Attorney General, an attorney must be “admitted to practice before the Supreme Court of this state for a period of at least five years immediately preceding his election …”. Becerra was barred from practicing before the California Supreme Court for the period in question because, for 26 straight years before Jerry Brown appointed him a little over a year ago, Becerra was an inactive member of the California Bar. Inactive members of the Bar cannot practice before the California Supreme Court. The Writ seeks to remove Beccera’s name from the ballot in the General Election.

The Petition states, “As the Attorney General’s office has made abundantly clear, experience in the law actually matters and is required to be the State’s top legal officer. Contrary to this requirement, Becerra possesses the ‘actual experience and skill in the law’ of a first or second year associate fresh out of law school.”

Early received almost 950,000 votes in California’s recent Primary for Attorney General and is represented against Becerra by distinguished attorneys Steve Cooley, the former District Attorney of the County of Los Angeles, litigator R. Rex Parris, currently serving his fourth term as Mayor of the City of Lancaster, California and Brentford Ferreira, renowned appellate litigator.

LOS ANGELES, CA – I jumped into the Attorney General’s race last October because like so many Californians, I was fed-up with the madness coming out of Sacramento – from the criminals’ paradise that has been created, to the politicization of the office by the present (unelected) Attorney General, to the so-called Sanctuary State, to the unchecked homelessness epidemic, to the out-of-control taxes on California’s hard-working citizens, to a culture of overregulation in Sacramento that is hell-bent on destroying the jobs our citizens need.

During the campaign, I traveled from San Diego County in the south to Siskiyou County in the north — and many places in between. The thousands of great citizens I met repeatedly told me, “We are being ignored by our elected leaders in Sacramento. We need to take back our state.”

Although the result of the recent election was not what we had hoped for, I want to thank all of you for your support in this race. Without you, this first-time candidate could not possibly have received the almost 800,000 votes (and counting), that we have received. Although not enough to make it to the general election in November, our message clearly resonated with a huge portion of the electorate.

While my campaign for Attorney General is over, the work to turn around our state is far from done. I look forward to continuing to do my part to make California again the Golden State. For example, my lawsuit against Xavier Becerra continues. Becerra was not an active member of the California State Bar for 26 straight years before Jerry Brown anointed him Attorney General. My distinguished legal team will continue litigating to determine whether Becerra is legally eligible to be a candidate in the general election in November.

Democrat Conspirators Trying To Rig California Attorney General Primary Election

LOS ANGELES, CA – Attorney General candidate Eric Early issued the following statement in response to a complaint filed yesterday by a third party with the California Fair Political Practices Commission, alleging violations of Government Code § 81004 by Democrat Xavier Becerra’s campaign and other co-conspirators, intended to rig the primary election to create a favorable general election outcome for Mr. Becerra. “The allegations that Xavier Becerra and his co-conspirators are attempting to rig the primary election are deeply concerning,” said Early. “The irony is not lost that some of the same Democrats who viciously promulgated a false narrative that Russia tried to rig the 2016 general election for President Trump now appear to be engaged in their own effort to rig an American election by deceptively purchasing airtime in support of an opposing candidate that will be more easily defeated in the general election.”

Xavier Becerra Is Legally Ineligible To Be Attorney General and Should Be Kept Off The November Ballot, According to Lawsuit

Suit Filed By A.G. Candidate Eric Early and his attorneys Steve Cooley and R. Rex Parris cites Becerra’s failure to meet the minimum requirements set out in the California Constitution and Government Code.

LOS ANGELES, CA – Appointed incumbent Xavier Becerra is constitutionally ineligible to hold the office of Attorney General and should be precluded from appearing on the November 2018 general election ballot, according to a lawsuit filed by Attorney General candidate Eric Early.

The lawsuit was filed this morning in Sacramento Superior Court by former Los Angeles County District Attorney Steve Cooley and noted litigator R. Rex Parris, who are representing Early. The lawsuit states that Becerra “does not and cannot meet the minimum eligibility requirements for the position of Attorney General.” Becerra was an “inactive” member of the California Bar for 25 years, from 1991 to 2016.

The lawsuit cites Government Code 12503: “No person shall be eligible to the office of Attorney General unless he shall have been admitted to practice before the Supreme Court of the state for a period of at least five years immediately preceding his election or appointment to office.” As of the November 6, 2018 general election, Becerra will have only been so entitled for a period of one year, ten months and five days.”

This eligibility requirement was added to the California Constitution in 1966 in order to close a loophole under which the state Constitution didn’t specifically require the Attorney General be admitted to practice before the state Supreme Court.

“The law is the law, and the state Attorney General, more than anyone, must be subject to it,” said Early. “The law must be applied equally to everyone, no matter how politically inconvenient. If we just look the other way when the state’s chief law enforcement officer is in violation of the law, then the message to California’s citizens is that there’s one standard for the rulers and a different one for the ruled.”

“This is not a ‘technical’ violation,” said Cooley, who served as Los Angeles County District Attorney from 2000 to 2012. “The Constitution mandates this requirement to ensure the Attorney General possesses the minimum legal experience to competently discharge his duties. Becerra doesn’t come close to meeting that standard.”

“Prior to being appointed Attorney General, Becerra hadn’t practiced law in a quarter of a century. According to the California Constitution, he is clearly ineligible to be Attorney General,” said Cooley. “We’re simply asking the court to apply the law.”

Philibosian served as LA County District Attorney from 1982 to 1984, and prior to that was Chief Deputy Attorney General and responsible for the daily operations of the California Department of Justice. He first joined the L.A.
